The Proceeds of Crime Act 2002 allows prosecutors to pursue the confiscation of assets they consider to represent the benefit of criminal conduct. In fraud cases, a Confiscation Order or Restraint Order can be made at an early stage, freezing assets before any criminal trial has concluded. These orders can have a significant and lasting impact on a business or individual.

We handle POCA proceedings alongside the main criminal defence, ensuring both aspects of the case are properly managed.

Whether an interview is voluntary or required depends on the circumstances of the investigation. Where an interview does take place, you have the right to a solicitor present. We prepare clients thoroughly for interviews, advise on whether to answer questions or exercise your right to silence, and attend with you throughout.

We strongly advise against attending any interview under caution without legal representation.

Fraud and financial crime investigations can be conducted by a range of agencies. Police fraud investigations are typically led by specialist Economic Crime units. The Serious Fraud Office investigates and prosecutes serious or complex fraud, bribery and corruption. The National Crime Agency focuses on serious and organised crime, including money laundering.
