A Letter of Claim (sometimes called a Letter Before Action) is a formal letter sent to a debtor before legal proceedings are issued. It sets out the amount owed, why it’s owed, and gives the debtor an opportunity to pay or respond before court action is taken.

Sending a Letter of Claim in the correct format is a legal requirement before issuing most types of court claim. We issue these on a fixed-fee basis for undisputed debts.

If the debtor fails to respond to the Letter of Claim or refuses to pay, we can issue court proceedings on your behalf. The debtor then has an opportunity to defend the claim. If they don’t, we can apply for a default judgment.

Once judgment is obtained, we advise on the most appropriate enforcement method to recover the money.

If the debtor disputes the amount owed or the basis of the claim, the matter may need to proceed to court for a judge to determine. We’ll advise you on the strength of your position, the likely costs involved and whether pursuing the claim is proportionate to the value of the debt.
