Compensation won in foot surgery claim

 

Sandy underwent day surgery at her local hospital for a bunion on her left foot.

Following the surgery, Sandy continued to feel pain in her big toe, making it difficult for her to walk, so sought further medical assistance which ultimately resulted in further multiple corrective surgeries on her foot.

After three operations, Sandy was left with toe deformity and prolonged pain and discomfort, which also led to her undertaking physiotherapy. These issues have and continue to have a detrimental impact on her day-to-day life including her work, and at the time of settlement, Sandy was still awaiting further surgery on her foot.

Sandy instructed Fosters Solicitors’ Medical Negligence team on a no win no fee basis.

Having acquired all relevant medical records and sought the opinion of an independent medical expert, a formal Letter of Claim was sent to the defendant hospital trust.

Although they denied the allegation that the first operation had not been performed to a reasonable standard, they did admit failings to perform an MRI and ultrasound scan during the first and second surgeries and substandard care was admitted concerning decision-making around the second surgery.

An apology was issued from the hospital and a settlement offer of £25,000 was put forward by the NHS. The offer was rejected and after further discussion concerning Sandy’s loss of earnings from her business, a counter proposal was put forward. Our solicitor, Nimisha Bhayani, who supported Sandy throughout her case, finally negotiated a final settlement with the defendant for £46,000.
