FAQs

Commercial Disputes FAQs

We handle the full range of commercial disputes, including contract claims and breaches, company and shareholder disputes (including unfair prejudice actions and derivative claims), professional negligence claims against solicitors, accountants, financial advisers and surveyors, defamation and malicious falsehood, intellectual property infringement, and property disputes. We act for businesses of all sizes across a wide range of sectors.

No. Our starting position is always to find the most cost-effective route to resolution. This often means negotiating directly with the other side or using alternative dispute resolution such as mediation. We’re happy to refer cases to independent, accredited mediators where that offers the best chance of a good outcome.

If litigation becomes necessary, we’re fully equipped to represent you in the High Court, County Court, arbitration or tribunal.

Yes. We act for businesses and individuals on both sides of commercial disputes. Whether you’re bringing a claim or defending one, our approach is the same: understand what you want to achieve, advise on your realistic options, and pursue the most commercially sensible route to get there.

An unfair prejudice petition is a legal claim available to shareholders who feel that the company’s affairs are being run in a way that is unfairly prejudicial to their interests. This might arise where a majority shareholder is excluding a minority, paying excessive salaries, or diverting business opportunities.

We act for minority and majority shareholders in these disputes and have experience in related claims such as derivative actions.

Costs vary depending on the nature and complexity of the dispute. We provide cost information at the outset and discuss the available funding options, including legal expenses insurance (LEI). Initial consultations with new clients are offered at reduced rates.

We’ll always advise you on whether the likely costs of pursuing or defending a claim are proportionate to the value at stake.

A professional negligence claim arises when a professional fails to meet the standard of care expected of them, causing you loss. We act for clients bringing claims against solicitors, accountants, financial advisers and surveyors who have made errors, and equally for professionals facing allegations of negligence.

The law generally aims to put the injured party back in the position they would have been in had the negligence not occurred. We advise on funding options, including legal expenses insurance, and aim to resolve these claims cost-effectively without litigation where possible.

We act in a range of commercial property disputes, including disagreements over the interpretation of lease or deed terms, boundary disputes, dilapidations, rent arrears, break clause disputes, and landlord and tenant matters under the Landlord and Tenant Act 1954.

We also advise on disputes relating to rights over land and obligations between neighbouring owners or occupiers. Whether the dispute concerns your commercial premises or investment property, we focus on cost-effective resolution at every stage.
