Damien is a Solicitor-Advocate and deputy head of our Crime & Business Defence department. He has represented clients in a range of proceedings, including murder, serious sexual assault and complex high-value fraud – as well as proceedings commenced by private agencies, such as the Driver & Vehicle Standards Agency, Trading Standards and the Maritime & Coastguard Agency.

As a Solicitor-Advocate, Damien regularly represents his clients appearing in the Crown Courts. He is one of a very small number of Advocates to hold a higher courts dual qualification in civil proceedings as well.

Having practiced in law for over 25 years, Damien has acquired a loyal client base who regularly instruct him. He has developed a niche for representing clients in the media spotlight.

In 2018, he acted in the Morrison’s murder trial, a high-profile case which saw his client acquitted of murder. In 2023, he headed up the legal team which secured the only acquittal of a group of defendants accused of being involved in a gangland killing.

Damien has provided legal commentary and opinion on television and BBC radio on a variety of topics, including drug conspiracies, the Milly Dowler murder trial and appeal work.

Damien has expanded his practice to encompass corporate criminal defence work. He is frequently retained by the Royal College of Nursing to defend nurses accused of criminal offences. In recent times Damien has secured the acquittals of senior nurses accused of gagging, deliberate beating and false imprisonment.

An accomplished advocate in the magistrates’ court too, Damien has secured recent acquittals in numerous trials, including successfully establishing the defence of modern slavery for a young defendant accused of supplying class A drugs – and of a teacher accused of assaulting a police officer, by establishing the arrest was unlawful.

Described by The Legal 500 as providing “unbiased, non-judgmental, and completely appropriate legal advice” and recommended for his role as a Solicitor-Advocate, Damien regularly represents his clients appearing in the Crown Courts.

About Damien

Described by The Legal 500 as a "leading light" and a "leading lawyer", Damien joined Fosters Solicitors in March 2008, before becoming a Partner in 2011 and then joining the Management Board as an equity partner in 2022. In December 2014, Damien was appointed to the judiciary and sits as a Chair of the Police Appeals Disciplinary Tribunal. This important work undertaken on behalf of the Home Office reflects Damien’s impressive ability in regulatory-based proceedings and requires him to objectively adjudicate upon all forms of police misconduct and poor performance. Damien has sat as a Tribunal Chair in some significant cases, including ruling for the first time on the relationship between an off-duty police officer and his claim to a right of privacy under Article 8 of the European Convention on Human Rights.
