Our Commercial Property team are vastly experienced in advising landlords and tenants on a wide range of commercial lease issues. We support clients associated with all types of premises, including shops, offices, warehouses, sports clubs and community centres.
Our Commercial Property team are expert in providing support to both landlords and tenants in relation to business tenancies.
This includes not only helping clients negotiate the terms of any lease, but also the full-range of conveyancing services in the case of the sale or purchase of a commercial property with an occupational lease – including undertaking the necessary enquiries, searches and registering their interest with HM Land Registry.
The Landlord and Tenant Act 1954 helps set out the rights and obligations of both parties in these contractual relationships, and has important implications for the wording of leases. We work closely with our clients to understand their requirements and ensure our leases give them complete security.
Our specialists have also acted in cases where either party has become insolvent, and a property is required to be sold or taken back.
If you are a commercial landlord, we can help you negotiate with your tenant, understand the rules regarding ‘security of tenure’ and assist you in the issuing of correct notices in respect of the statutory rights granted under the 1954 Act.
For business tenants, we can advise you on your obligations under a lease and seek to negotiate clauses and provisions with your landlord’s solicitor.
We will work with you to put in place a set of documents that you are comfortable with and fully understand.
We will work in your best interests – whether that’s working to promptly and efficiently ensure the occupation of your property as quickly as possible after agreement of the heads of terms; covering all angles from pre-letting enquiries, planning consents, all relevant searches, licences, leases, rent deposits and advise upon any relevant legislation which will affect you – or doing our utmost to get you into your new premises quickly and make sure you know what your obligations and rights are in the future.
Please contact us with the details of your particular matter and our team will be happy to explain how we can help further.
Our Commercial Property experts are knowledgeable and experienced in providing the necessary legal support that should form part of any lease negotiation.
It is important that the terms you negotiate reflect your requirements as a business owner or protects your asset as a landlord.
We work with our clients to fully understand the terms important to them and whether fixed-term security or a more flexible approach is desired depending on their own commercial circumstances.
Our team can help you structure your negotiations surrounding the length of the term, rent, rights to renew (security of tenure), Landlord & Tenant Act 1954 protection, break clauses, repair obligations, incentives and payment security (guarantors and rent deposit deed).
We aim to give you security and protection in your negotiations, safe in the knowledge that you are putting into place a lease that is right for your commercial needs.
We regularly support clients who are wishing to renew their commercial lease and potentially looking to negotiate new terms as part of this renewal.
Firstly consideration needs to be given to whether you have a lease with or without ‘security of tenure’ – this provides the tenant with an automatic right to renewal at the end of the lease term under the Landlord and Tenant Act 1954. If not part of the original agreement, the landlord is under no obligation to offer a new lease when the end date is reached. Alternatively, if there is a security of tenure, or both parties are open to negotiation then new terms can be negotiated and put in place.
Whether you are a tenant or a landlord, we can help you with this negotiation and initiate the relevant section notice to the other party.
Our Commercial Property specialists are experienced in all types of lease renewal.
