You’ll be interviewed under caution about the allegation. You have the right to legal advice before and during the interview. We advise whether to answer questions or exercise your right to silence, and we’ll be present throughout. The interview is recorded and can be used in evidence, which is why having representation before you speak is so important.

Yes. You have the right to free legal advice if arrested or invited to a police station for a voluntary interview. Ask for Fosters Solicitors and we’ll arrange representation. There is no obligation to continue using our services afterwards.

Magistrates’ court handles less serious offences and preliminary hearings for more serious cases. Crown Court handles serious criminal offences and trials, where you have the right to trial by jury. Cases are sent to Crown Court by magistrates when the offence is serious enough to require it. We represent you in both.

You should only decide after taking full legal advice on the evidence and likely outcomes. Pleading guilty means the court proceeds to sentencing and may result in a reduced sentence, but you’ll have a criminal record. Pleading not guilty means the prosecution must prove the case beyond reasonable doubt at trial. We assess the evidence and advise you on your realistic options before you make any decision.
